A Parisian court has fined online marketplace eBay 1.7 million euros for violating an injunction that prevents French users from buying or selling LVMH cosmetics including Christian Dior, Guerlain, Givenchy and Kenzo.
But the company said the fine was too high, and that the injunction blocking the sale of such products hurts its users.
“The injunction is an abuse of ‘selective distribution,’” Alex von Schirmeister, general manager of eBay in France, said in a statement. “It effectively enforces restrictive distribution contracts, which is anti-competitive.”
“We believe that the higher courts will overturn this ruling,” he added.
The move comes after the company received a fine last year of $57.2 million, due to the sale of counterfeit LVMH items on its site which led to the injunction.
